The Supreme Court has warned people who choose to travel as a passenger in a vehicle driven by someone who they are aware, or are reasonably aware has consumed alcohol, that they could themselves be partially liable to for any injuries that occur should an accident take place.

Mr Justice Nicholas Kearns said that any tolerance towards intoxicated drivers and their passengers ‘is very much a thing of the past.’

The judge said that if a passenger had realised or should have realised the risks being undertaken by travelling with a drunk driver, the greater degree of contributory negligence they should take. However, Mr Justice Kearns did say that cases of contributory negligence should be approached objectively and be taken on the individual circumstances of each accident and car insurancecover.

The understanding of the role alcohol has in road accidents changed dramatically over the last 40 years, largely thanks to the work of anti-drink-driving societies and campaigns and the continued rise in the number of deaths on the roads.

Mr Justice Kearns gave the Supreme Court judgement when upholding a High Court finding that a young business student, Cynthia Hussey, was found to be 40 per cent liable for injuries sustained in a 1999 accident whilst travelling as a passenger in a vehicle driven by a friend’s boyfriend who had been drinking. Because of this, the High Court had reduced Ms Hussey’s award of €83,000 by 40 per cent, leaving her with damages worth €50,000.

Despite an appeal from Ms Hussey, the three-judge court dismissed it, with Mr Justice Kearns saying the award was still ‘generous’ in light of the ample evidence presented to them.

Ms Hussey had originally sued the Motor Insurers Bureau of Ireland for back injuries she had allegedly received during the smash and the owner of the car, her friend and her friend’s then boyfriend, the driver of the car the night of the accident.

The Motor Insurers Bureau of Ireland was joined to the case due to the driver not being insured to drive the car. The defendants admitted liability but alleged contributory negligence by Ms Hussey for allowing herself to become a passenger in a car she knew or should have known was being driven by an intoxicated person, as she had be drinking that night with the driver.

Mercury Car Insurance
Are there rental cars that can be covered by personal car insurance?

I was wondering this because I wanted to rent a car but was afraid that I’d have to pay for the extra cost of insurance that the car’s under. I have Mercury as an insurance and want it to use as my insurance instead of paying. Thanks… ^_^ v

If you don’t have a non-owned vehicle rider on your policy, it won’t cover a rental. You buy a policy to cover one car, not however many as you may borrow or rent.
Unless you have a basic policy, your liability may cover you, but not collision or comprehensive. Call your insurance agent to find out if you can buy what is called a vacationer’s policy, which is a short term non-owned vehicle policy, to cover a rental vehicle. As an insurance broker I sold hundreds, maybe thousands of those, I never counted.

Car Insurance Quotation

When you’re ready to compare your car insurance quotations, you’re most probably at the stage where you know the coverage you asked for is suitable and sufficient for you. What you’re going to compare are mainly the premiums that different car insurance companies charge for similar benefits. This little extra time spent to obtain and compare quotes from different insurers can do wonders for your wallet, because you can get the best deal.

You can get quotes by calling different agents, or simply punch in your basic vehicle, personal and current car insurance details into an online quote site. These sites provide you with free quotes from five or more insurers per request and you’re not obliged to purchase from them. You will save a cart-load of cash if you take time to visit more than two or three quotes sites.

The two important things you have to take note as you compare those online quotes are as follows:

1. Premiums and Benefits. Make sure that the premium stated in the quotations corresponds to the benefit that you require. Human errors do occur from time to time. Although it may sometimes be difficult to get quotes for (exact) similar benefits from different companies, the coverage limits and deductibles, as well as exclusions clause and conditions should not differ much. Otherwise we’ll not be evaluating these quotes fairly. This takes a little more time than the next point.

2. Ease of Claim. What good is it if you can get the cheapest auto insurance yet when you need to make any claims, the insurance company takes days to respond to your requests… And when you finally get through their hot line again, the answering machine puts you on hold for endless minutes before you can speak to an actual person who’s outright rude?

Once you’ve identified a suitable low-cost insurer to purchase from, do yourself a favor by dialing in to their customer service hot line and their claims services hot line. Speak to their service officers and see if you’re comfortable with how they treat their customers.

Before you finally sign up for any auto insurance, do a quick (final) check to see if there are discounts you qualify for and what the eligibility requirements are. After you have done your due diligence by going through the two points above, you will very likely get an auto insurance that can serve you for many months to come – regardless whether you need to make claims or not.

Commercial Car Insurance

Yes, ladies and gentlemen, we are living in the era of the reemergence of the small business. Thanks to the power of the Internet small, independently owned companies are once again on the rise, and we’re seeing an absolute boom of small niche stores the likes of which haven’t been seen since the department store came to town! If you’re a small business owner, congratulations. You’re a part of a new era in history. Now what are you doing about your car insurance?

Most of us don’t think a whole lot about car insurance when we’re starting a small business. Sure, commercial trucking companies and rental cars need a commercial car insurance policy. That’s just a given. But what about the little guy? What about the private contractor or the Mary Kay sales professional? You might be surprised to find out small businesses like these need commercial car insurance coverage just as much as the next guy.

What’s the Difference Between a Commercial Car Insurance Policy and an Everyday, Ordinary, Run of the Mill Policy?

One of the questions insurance agents hear the most is, “What’s the difference between a commercial policy and a regular one?” The differences are subtle, so they’re a little tricky. First and foremost, a personal car insurance policy won’t cover accidents that take place while you’re on company business. Picking up the boss’s dry cleaning once a month doesn’t usually send too many red flags up, but if you’re on the road all day, every day you need to make sure you’re covered by a policy that’s going to do its best to keep you safe out on the highways.

Commercial policies are designed specifically for businesses and offer not only a convenient paid claims service for drivers out on company business but also higher liability limits, which is good news when you’ve got a flatbed full of lumber. And they’re almost always more cost effective at this higher level of coverage than just about anything else on the market, meaning your car insurance rates are going to be considerably lower than they would be if you’d simply tried to cover your car under a regular car insurance policy.

Not to mention a full fledged commercial car insurance policy is going to cover your employees if and when they have to take a company vehicle out on the job, saving you from the inevitable employee that decides to re-enact “Thelma and Louise” during their lunch hour.

Who Needs Commercial Car Insurance?

The people who need commercial car insurance include (but are not limited to):

• Catering
• Newspaper Deliver
• Door-to-Door Sales or Consulting
• Landscaping/Snowplowing
• Day Care
• Real Estate

In other words, if you’re going to be spending even part of your day out on the roads you’re going to need a commercial car insurance policy standing by keeping your car safe. Remember, a commercial policy isn’t just something as nice to have (although it is). It’s a necessity for any business whose profit and loss sheets have a healthy sense of self preservation.

As a small business you’ve got enough expenses. Do you really want to add to them because you didn’t pick up the right kind of car insurance?
